Wives and Section 375 IPC

Just a funny post and some of you may need parental permission to read it ;-)

Last week..when a bunch of junior advocates and wannabe advocates were idling at the office , the conversation turned to sec375 IPC.

For the purpose of this post..I will give a brief intro to secs 323,324 ,325,326and sec 375 of The Indian Penal Code .

Sections 323 to 326 deals with causing bodily injuries and the degree varies according to the weapons used and the gravity of the injury.

In Sec.375 ...The main aspects that constitute rape
1. is 'against the will' of the woman
2. and 'without her consent'
3. or fraudulently obtaining consent misleading the woman to believe that she
is his wife
4. with or without her consent when she is under sixteens years of age
5. or with a girl less than the age of fifteen if she is his wife.

It clearly says that the husband is protected from sec375 if she is his lawfully wedded wife (consent is granted) .

Almost all the women felt that the section shd be amended to include wives too . That is, the husband needs the consent of the wife...and it shd not be assumed that the wife has given her consent. Its either the wife be protected by sec375 or the husbands should be excluded from secs 323 to 326 IPC.

And as expected , the argument would be what if the wife agrees and then out of some other spite files a case against her husband...what defense would the husband have..what proof would he produce ? (There were jokes like..he shd keep a stamp paper ready to get her express consent :p :)) ).

Well...lets see the legal implications if the section is amended...the husband is in no better legal position than a man having an affair with any other woman . In affairs, the man is definitely exposed to sec.375 , if the lady decides to give the guy a difficult time . If a man is charged with rape and he claims he had her consent , the onus of proof is on the accused. Ofcourse he can always prove that they were going out together and she was his girl friend etc . But , its a hassle , and a major one.

I remember watching a movie where a high-school girl files a case against her school-mate for rape .She has an affair with him but subsequently breaks up with this guy..after the break-up, one late evening in the school premises he rapes her in his car and his current girl friend sees that. It would be argued in the court that since she previously went out with him , it would not amount to rape. But finally the girl friend becomes a witness and gives evidence that she heard the girl scream , saw the girl protest inside the car and she knew even at that time ,that it was rape.Finally the boy would be convicted . That was one new angle to the whole picture. (I really did'nt pay much attention to the name of the movie..).

Back to our topic..if the section protects wives..many husbands would rather lead a life of celibacy than get into trouble . The argument from the wives is that since they are not protected u/s375 IPC, (as it is now) , the only option for them would be to resort to violence . The sections that protects all from bodily injury are secs 323 to 326 IPC .(Men have no protection under Domestic violence act ).

The demand is if wives are not included in sec375 then husbands shd not be included in sec 323 to 326 (Its only against their wives..its applicable when the offender is anyone other than his wife).

They either get the consent or get beaten up . They have no legal help if they are bashed up by their wives .Ah..what a solution !

But all this would only lead to marital discord. And the next step is usually the family court or some marriage counsellor..and what would the advice be...'Concentrate on some activity that engages you or learn something new'...yeah and in the situation....the wife would opt to go to 'karate' classes and the husband shd attend 'body-building' classes :)

And all would be hunky-dory between them.....the women protects herself and the man can have fun too..whether he has his wife's consent or not.

Now , do you get the point ....that its the height of absurdity to ask for wives to be protected under sec375 IPC ? The very idea behind the institution of marriage fails if this is done . I strongly feel things should be left as it is .

Abusing is one thing..and having sex with one's legally wedded wife is another thing . No man can be expected to wait in anticipation as to getting the consent of his wife...absurdity !!! If the wife has no desire...then it reflects in all other aspects of the marriage too..and the course of action would be to address those problems..instead of filing a rape case against her husband...or worse still..resorting to what u have suggessted .

well even if we take ur argument...the wife loses her marriage either way ..so why not deal with it legally..a married women is protected by 498A . She gets remedy there. This would cover sexual abuse too.

The kosten I have raised here has nothing to do with social awareness or problems faced by India...I agree that India has sooo many problems.I was just sharing my view as to the impracticalities of including wives u/s 375.

Pegasus...actually this was to be my post during the recent bandh in TN ..no...not the problems faced by India..but what we are doing about that...what did we do during the bandh?

No ,its not ok ! The law is being amended at a snail's pace...it was 12 yrs earlier.
But there is not much of a difference.

But what about a 23 yr old man who has an affair with a major girl and after a break up is accused of rape ? What protection does the man have ?
And what about adultery , pegasus..I absolutely agree with ur opinion about this law in ur post. why shd the women go scott-free ?

I thgt as much. I was going throo all the sections regarding this..and finally consulted the senior..a new act is being enacted to protect minors (child molestation) now. But as of now the sections covering bodily injury is the only resort.

its a chicken and egg situation... u cannot have a large no of clients unless u have a big office, a long waiting queue etc etc... but u cannot afford them unless u have a clients.

maybe allowing foreign competition might help.

That marriage is voidable but the husband cannot be penalised u/s 375 .

They would'nt stand a chance in criminal practice atleast in states like TN where witnesses speak the local lang., depositions are taken in the local lang. and even the judgements are given in the local lang. .

why would a foreign firm undertake litigation??? esp when it takes 1-2 decades before the final verdict can come.

the most lucrative part of the legal profession is framing IRON CLAD contracts and consultancy..
and there these foreign firms can hire bright students and use their brand-name to get the clients...
they might even reduce the inequality among the lawyers....

I think u r mistaken...the real money lies in litigations and esp the ones that drag for decades..
Drafting contracts and some simple consulatancy are just routine work.

On a personal level..I welcome it..I really wish we get some quality lawyers.
I have not analysed the overall impact of this..but I guess the clients would be benefited too. And if the bright students are our lawyers..then why complain.

I always thought there were only 2 kinds of lawyers... one who are filthy rich and others who live in filth...
but seems like there is a growing middle class in lawyers too.

As far as I know..this is like any other service industry. Well..actually it can be compared to a doctor's profession . If the young doctor has atleast one doctor parent and even a small hospital ready..then his career is very smooth as compared to one who is starting out fresh. If a lawyer is attached to a flourishing office and is a preferred one..yeah..sorry to say that.... then he/she can have a smooth career , if a little bright.

But for a person who has no such cushioning ..he either has to come out of top law schools and do a specialisation in a British school and join a good office or get a job in an MNC as their legal advisor.
Well..the pay is like for any management graduate.

There is the other category ..every office needs a responsible and bright lawyer , and one who can just be present in the office and handle the clients learn a lot and the work comes his way automatically.

The mega bucks is only in private practice.
And there is always judicial posts.(naa...no money there :) )

Well...yeah there are the super rich...starving kind and probably the middle class..(but I think its not the profession that put the last two categories there). If you dont grow..then u stay where u started out.

no wonder, even after 60 years we utter phrases which has no relevance in Indian life.

i always thought the economic disparity between lawyers is very very high. but then i do not know many people in the profession.

Sree, first, I could not comprehend the post fully and two, with whatever I could decipher from the post, it only reiterates that men are also subject to discrimination, its just that they don't open up as much as women do. And these rape/molestion/dowry demand accusations, I think these days many women use it to their convenience. Infact, I have seen this from close quarters. A son of someone whom I knew had problems with this wife. He decided to opt for divorce and the girl's dad, to avoid this, made a dowry harrasement complaint against their family. I could give many such instances about the discrimination against men :)

Well , specialisation helps as the masters in India is not too great..
Corporate and commercial laws either in US or UK gives a good understanding of the subject. Criminology is better in the UK as our law is based on the British law. But in both the cases ,the gain is marginal... only thing is that a foreign degree fetches a good job.

Lets face it Pegasus...there are dime a dozen Law colleges in India and the fees structure is not too high (as compared to other professional courses). It goes without saying that it is accessible to all strata of the society. I guess this explains the economic disparity among lawyers.

And also the subjects are structured in such a way it is not too difficult to finish the course. One can takes his own sweet time to finish it .The result is abundance of lawyers ...and most of all, unlike engineers (though they are produced in bulk) , the subject is exclusive to India..so the market is limited.

No , Ravi..atleast the sections that I have dealt in this post do not discriminate against men..on the contrary protect men (married men).

I hope u'd be happy to know the post is about ensuring the rights of husband towards his wife.

Your friend's son is not alone..and there is a new class of cases coming up (fondly called the software cases) ..where the husband is in the US and the wife comes back to India after a brief marital stint in the US and files dowry harrassment case against all her in-laws. It will take a long post to talk of sec498A.
(Oh ! I am yet to see a man who does not crib about this section...even this afternoon our office clerk was saying "amma thayingala..engalukkum oru 498B podungamma...adi odhai thaangalamma" )
A wife who has given up on her marriage , can bring her husband down on his knees..using this one section.

Can u believe a lawyer I know took an injuction against a wife who was bashing up her husband ? The judge was shocked..and later the husband had taken the order to the Police station where the police advised the wife and sent them back...now Ravi...stop laughing !!!

But Ravi..for every case I said above there are 30 wife-beating cases.
Dont go by anybody's professional behavior...the lamb u see in the office wld be a wolf in marital life.
But ofcourse there are some sections like adultery that is grossly discriminating.

Hmmm.. thanks for the long explanation Sree. Well, you see... when a man suffers at the hands a woman, its funny. Nobody takes that seriously. But more than the physical toture, its the mental toture which is painful. Even when it comes to divorce, even if the wife is educated, has a job and is well off, the husband has to shell out solatium (unless she declares that she does not need one). And that is why I hate most "Magalir sangams". Whenever there is an issue between a man and a woman, they take up arms and start their protests against the man - not even investigating the root cause. Is this what is fighting for women?

Btw, I am still out of town. Vacation post dhaane? Adhaan oru maasathukulla post pannidaren-nu sonnene!! (Reminds me of assignment submission in college)

Ravi..when it comes to divorce..all civil behavior is thrown to winds and the only thgt is that..'lets teach him/her a lesson'. That's a sad state.

yeah...mental torture is more painful than the physical one..but it happens to both the parties , Ravi..and when kids are involved..it is even more traumatic..(I have seen kids waiting in the office , for the father to take them for a few days with his visiting rights..its pathetic ).

Oh lets not talk of 'Magalir sangams'..its akin to Richard Gere kissing Shilpa poppadam :P

actually people in services industry are much better off.
1) in traditional industry like catering, shops, transport... they can create their own niche.
2) in modern IT/ITES a lot of freshers are employed at salaries which is much more then what their parents had drawn at time of retirement.
Infact IT/ITES/BPO are going to create a revolution... so big that this generation can be call off shoring generation.

Its hard for me to imagine why on earth a Lawyer practicing in india needs to understand law of a country he might never get a chance to visit/interact.

My mathematics says otherwise...
"What percentage of the value which the education adds to the student is paid as fees?"
if u use this formulae.. probably LLB might not be that cheep.

plus seriously education in India is practically free. It would take me less than 6 months of pay to pay for my tution fee, living/boarding and hostel fees of my IIT education. (and i was too stupid to get the scholarship which >25% of students get)

Fees has never stopped a brilliant student from graduating..

u know I used to make queries about course only 24 hours before the exam.. and same holds true for 90% of engineers... and rest of them are nerds.

but one thing shree this is one debacled event happened in my life.
The status-quo is
one of my close friend ( who passed away after her marriage )sister's marriage in broken state. They were in helpless stage at one point of time. just a girl and her mom thats.

i was involved in moving around to police station , etc etc.
later what i understand w.r.t to my lame 2 months interactive knowledge is in this context - girl is kind supportless if she willign to move out of marriage contract for any x,y,z reason.
reason could be subjected to 32x IPC.

by all means ur conclusion is perfectly all right if things are fine, good, less perfect where there is no need for law, ipc.. mutual understanding good will takes it to next state.

but definitely law needs to resuce thigns in adverse stituation and not be applied for wrong cause.

Actually ya..somewhere outside Chennai..
I think u too shd forget the share thing and look for a decent plot . You dont need to pay the entire amount to rotate ur money in real estate , pegasus.

I would'nt call buying an apartment investing in real-estate..well it appreciates but not like vacant land. But if u need an apt to live then , u shd buy one.

hmm..I think u r being hasty. People want to invest in real-estate as they feel they have acquired a solid property..so when there is spare money..its plots they think of.
Even....if rupees fall , there is usually a spurt in land costs that would cover all losses if you hold out for long enough.
As for money being tied up , if u have a better option which would fetch a better return on the sale proceeds of the land (taking the waiting period into consideration) , you shd ignore losses and sell out .

if I buy a 10L property today, and sell it tomorrow (at same price)
after u pay the brokerage, registration, cost of visits etc you will be left wit 8.1L... transaction costs are 10 times that of other assets. so the only way to make a killing is to hold long enough that acquisition cost becomes negligible.
